You represent that you have the legal capacity to enter into these Terms and that you will comply with all applicable laws. If you are a minor, you may use the Services only with the consent and direct supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.
CustomCast provides an AI-assisted voice and text companion that answers questions about, explains, and summarizes publicly available online videos, along with related tools and features.
The Services are an educational and informational tool ONLY. They do not provide professional, legal, financial, medical, or other specialized advice of any kind.
You acknowledge and agree that:
Artificial intelligence systems may produce inaccurate, incomplete, inconsistent, or misleading outputs, and may return different results for identical inputs. You must not rely solely on AI-generated content for any important decision. All AI content is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
You acknowledge that you use the Services entirely at your own risk. You agree to comply with all applicable laws and with YouTube's Terms of Service and all other applicable third-party terms. You are solely responsible for the videos and content you choose to access or use with the Services.
You retain ownership of the content you submit to the Services. By submitting content, you grant PingSolve LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works from that content for the purposes of operating, providing, improving, and developing the Services.

The Services are offered with a free trial that requires a valid payment method, followed by a one-time unlock fee (currently $20) for continued access. This is not a recurring subscription. If you cancel before your free trial ends, you will not be charged.
Payments are processed by our third-party processor, Stripe. Except as required by law, all fees are non-refundable. Credits represent a limited license to use the Services and are not money, stored value, or redeemable for cash. We may change pricing prospectively at any time.
All rights, title, and interest in and to the Services — including the software, algorithms, AI models, designs, text, graphics, and other content (excluding your content) — are and remain the exclusive property of PingSolve LLC or its licensors. No rights are granted except as expressly set out in these Terms.
We may suspend, restrict, or terminate your access to the Services at any time, for any reason or no reason, with or without notice, and without any liability to you.
The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties or representations of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by law, PingSolve LLC and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Services. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Services shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless PingSolve LLC and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or any applicable law or third-party rights.
CustomCast and PingSolve LLC are not affiliated with, endorsed by, sponsored by, or partnered with YouTube, Google LLC, or any content creator, channel, or rights holder. References to "YouTube" are used solely to describe interoperability and the general nature of the Services. All trademarks, logos, and brand names are the property of their respective owners.
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through individual binding arbitration administered by the American Arbitration Association (AAA) in Boise, Idaho. You waive any right to a jury trial and agree that disputes will be brought only in your individual capacity and not as part of any class, collective, or representative action.
We may modify these Terms from time to time. Changes are effective immediately upon posting the updated Terms, and your continued use of the Services constitutes acceptance of the modified Terms.
